Terms of Service

These terms govern your use of internet and related services provided by 2Mail Internet (Pty) Ltd ("2Mail", "we", "us"). By applying for, accepting or using any 2Mail service, you confirm that you are of legal age, that you have read and understood this agreement, and that you agree to be bound by it.
The Agreement
This agreement is between you (the account holder) and 2Mail Internet (Pty) Ltd, a company registered in South Africa, operating from Welkom, Free State. It applies to all services we provide, including uncapped wireless internet, networking, web and hosting services.
If these terms, or any change to them, are or become unacceptable to you, your remedy is to stop using the service and cancel your account in terms of Section 6.
The Service
2Mail provides fixed wireless internet access. Our residential and business packages are uncapped and unshaped: we do not apply data caps, throttling or fair-usage policies to your package speed. Actual throughput can vary with radio conditions, distance from infrastructure, weather and network load.
Installation is performed by 2Mail technicians following a site survey. Equipment supplied as part of an installation (outdoor radio, router, cabling and mounting hardware) remains part of the service as described in your installation quotation.
Equipment liability: 2Mail will not be liable for any damage to the radio transmitter or router caused by the client, bad weather, lightning, storms or power surges. In such an event, the client will be responsible for the replacement of the damaged equipment.
Billing & Payment
Subscriptions are billed monthly in advance and are due at the beginning of each month. We accept debit order, EFT and direct deposit. Where you elect debit order, you authorise 2Mail to collect the monthly subscription (and any agreed once-off amounts) from your nominated account on the agreed striking date.
A rejected debit order or returned payment may incur a reasonable rejection fee, which will be reflected on your next invoice. If your account falls into arrears, we may suspend the service until the outstanding balance is settled. Suspension does not stop the monthly subscription from accruing while the agreement remains in force.
If you are experiencing payment difficulty, contact accounts@2mail.co.za or call our office on 087 012 5215 - we would rather arrange a payment plan than suspend a connection.
Cancellation
You may cancel the service by giving us notice of one calendar month, in writing, to accounts@2mail.co.za. The final billing month is payable in full. 2Mail may terminate this agreement on the same notice, or immediately in the case of breach as set out in Section 10.
In the event of a cancellation, if your account has not been settled, 2Mail retains full rights to reclaim the equipment supplied as part of your installation.
Conditions of Access
2Mail grants you access to the service in line with this agreement. You agree that you will not attempt to circumvent 2Mail's authentication processes or attempt to access any part of the 2Mail network where you are not expressly authorised to do so. Failure to comply with this provision is a breach of this agreement.
Acceptable Use
The service may only be used for lawful purposes and in a manner consistent with the rights of other users. The service may not be used to violate any law, or to infringe any copyright, trademark, trade secret, right of publicity, privacy right or any other right of any person or entity, nor to access, transmit or store material which is obscene, libellous or defamatory. Illegal acts may subject you to prosecution under South African law. In particular, you agree that you will not:
- download or share copyrighted materials unlawfully;
- run programs, services, systems, processes or servers that substantially degrade network performance or accessibility for other users, including saturating network resources with traffic (whether legitimate, such as bulk backups, or malicious, such as denial-of-service activity);
- send electronic chain letters, mail bombs, or email containing viruses or other malicious software;
- access another person's computer, account, files or data without permission;
- attempt to circumvent or subvert system or network security measures, create or run programs designed to identify security loopholes, decrypt intentionally secured data, or gain unauthorised access to any system;
- use any means to decode or otherwise obtain restricted passwords or access control information, or forge the identity of a user or machine in an electronic communication;
- collect or attempt to collect personal information about third parties without their knowledge or consent, or otherwise violate the privacy of any person.
Should you engage in any of the above, this shall be considered a breach of this agreement.
Your Responsibilities
You are responsible for the security of your own devices. Connecting devices to the internet exposes them to worms, viruses, trojan horses, denial-of-service attacks, intrusions, packet-sniffing and other abuses by third parties. We strongly recommend running up-to-date anti-virus software and taking security measures suited to your situation and intended use of the service. 2Mail does not provide these solutions and cannot be held responsible for their effectiveness. You are responsible for any actions taken from your devices, whether intentional or unintentional, that damage or otherwise affect other devices or users of the service.
Service Availability
2Mail will within reason attempt to keep the service available at all times, and maintains backup power on key infrastructure to limit the impact of electricity disruptions. However, no network is immune to interruption. Except where a written service level agreement states otherwise for a specific business service, you agree that 2Mail is not liable for loss or damages caused by or arising from the unavailability of, or any interruption in, the service, including business interruption, loss of business information, loss of data or other pecuniary loss, regardless of the nature of the claim and even if the possibility of such loss could have been foreseen. 2Mail reserves the right to interrupt the service for maintenance, upgrades or security operations.
Monitoring, Security & Privacy
2Mail respects the privacy of users of this service and will not intercept the content of your communications. We do, however, reserve the right to monitor internet usage patterns and volumes to manage the performance, security and legal compliance of the network, and to take whatever action we reasonably find necessary to preserve the security and reliability of the network. Any personal information encountered in the course of such operations is held in the strictest confidence, is not passed to any other party unless required by law, and is not retained beyond those purposes. Breach
Should you be in breach of any provision of this agreement, 2Mail shall be entitled, without prejudice to any other rights it may have and without notice, to suspend your access to the services and/or terminate this agreement, and to disclose information relating to your actions to persons affected by them or to authorities where required by law.
Indemnity
You unconditionally and irrevocably indemnify 2Mail and agree to hold 2Mail free from all loss, damages, claims and/or costs of whatsoever nature suffered or incurred by 2Mail, or instituted against 2Mail, as a direct or indirect result of your use of the service, your failure to comply with any provision of this agreement or any other requirements which 2Mail may impose from time to time, or any unavailability of or interruption in the service as contemplated in Section 8.
Changes & General
We may update the service, its features or these terms from time to time. The current version will always be published at this address, and material changes will be communicated to account holders. This agreement is governed by the laws of the Republic of South Africa.
